Terms of Service

These Terms of Service govern access to and use of the Kineration website, applications, content, and related services. By accessing or using Kineration, a user agrees to these Terms.
1. Eligibility and Accounts
Users must be legally capable of entering into a binding agreement and must provide accurate, current, and complete account information.
If Kineration allows use on behalf of a household or family group, the person creating the workspace is responsible for invitations, permissions, and account administration within that workspace.
A user is responsible for maintaining the confidentiality of login credentials and for all activities occurring under the account, except to the extent caused by Kineration's own misconduct.
2. Family Accounts and Shared Data
Kineration enables users to organize and share family-related information. Content shared within a family workspace may be visible to family members, invitees, caregivers, or other participants based on permissions, settings, and feature design.
Users are responsible for choosing what information to upload, whom to invite, and what permissions to grant. Users should not upload another person's information without appropriate authority or consent.
3. Acceptable Use
Users may not:
- Violate any applicable law or regulation.
- Upload unlawful, fraudulent, defamatory, infringing, abusive, harassing, or harmful content.
- Use Kineration to exploit or endanger minors.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Interfere with the operation, security, or integrity of the service.
- Reverse engineer, scrape, copy, or misuse the platform except as permitted by law.
- Upload malware, malicious code, or harmful files.
- Use the service to send spam or unauthorized commercial communications.
4. Children and Minors
A parent or legal guardian must supervise any use of Kineration involving minors. Kineration does not knowingly allow children under 13 to create their own independent accounts. Family account holders who enter information about children under 13 represent that they are the parent or legal guardian of those children and consent to Kineration's collection and use of that information as described in the Privacy Policy.
Kineration may suspend, restrict, or remove accounts or content if it believes a user has violated child safety rules, misrepresented age, or used the platform in a way that creates risk to minors.
5. Subscription, Billing, and Payments
Certain features may require a paid subscription. Kineration clearly discloses pricing, trial terms, billing frequency, renewal terms, refund rules, and cancellation instructions at the point of purchase.
Unless otherwise stated, subscriptions may automatically renew until canceled. Users authorize the designated payment processor to charge the selected payment method according to the plan chosen.
6. User Content
Users retain ownership of content they submit, post, upload, or store through Kineration, subject to the rights granted in these Terms.
Users grant Kineration a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use user content solely as necessary to operate, improve, secure, and provide the service, and to comply with law.
Users represent and warrant that they have the rights, permissions, and authority needed to submit the content and to grant the license above.
7. Intellectual Property
Kineration and its underlying software, design, branding, content, and service materials are owned by Kineration or its licensors and are protected by intellectual property laws.
Except for the limited right to use the service in accordance with these Terms, no rights are granted to users by implication, estoppel, or otherwise.
8. Feedback
If a user provides feedback, suggestions, ideas, or recommendations regarding Kineration, Kineration may use them without restriction or obligation, unless otherwise agreed in writing.
9. Availability and Changes
Kineration may modify, suspend, or discontinue any part of the service at any time, with or without notice, subject to applicable law.
Kineration does not guarantee that the service will be uninterrupted, error-free, or available at all times.
10. Third-Party Services
Kineration may integrate with or rely on third-party services, including payment processors, cloud providers, messaging tools, travel providers, map providers, analytics vendors, and authentication services. Kineration is not responsible for third-party products or services except as required by law.
11. Disclaimers
To the maximum extent permitted by law, Kineration is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
Kineration does not warrant that the service will meet every family's needs or that data will never be lost, delayed, intercepted, or corrupted.
Kineration is not a substitute for professional medical, financial, legal, counseling, religious, childcare, travel, tax, or emergency services advice.
12. Limitation of Liability
To the fullest extent permitted by law, Kineration and its affiliates, officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or use.
To the fullest extent permitted by law, the aggregate liability of Kineration for all claims arising out of or relating to the service or these Terms will not exceed the greater of: (a) the amount paid by the user to Kineration in the 12 months before the event giving rise to the claim, or (b) $100.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply.
13. Indemnification
Users agree to indemnify, defend, and hold harmless Kineration and its affiliates, officers, employees, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to the user's content, misuse of the service, violation of these Terms, or violation of law, except to the extent caused by Kineration's own negligence, willful misconduct, or other non-waivable liability.
14. Termination
Kineration may suspend or terminate access to the service if a user violates these Terms, creates security or legal risk, fails to pay required fees, or if Kineration discontinues the service.
A user may stop using the service at any time and may cancel an account subject to any applicable subscription commitments.
15. Governing Law and Disputes
Governing Law: State of California, without regard to conflict of law principles.
Venue: State or federal courts located in San Diego County, California.
16. Changes to the Terms
Kineration may update these Terms from time to time. Continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
